RELEASE BY A LEGATEE IN FAVOUR OF AN EXECUTOR

THIS DEED of Release made this ……….day of ….20……….between A, son of resident of ……….of the ONE PART and B, son of resident of ……….of the OTHER PART.

WHEREAS one X died on ………. day of ……….20 ……….at…………….leaving a will dated whereby and where under he appointed the said B as the executor of his estate unto and in favour of the said A absolutely and forever.

AND WHEREAS the said will was duly proved in the ………………. Court and probate thereof was granted unto and in favour of the said B on the day of ……….20 ……….

AND WHEREAS the said B has duly and faithfully administered the estate of said X and filed the account and inventory in the …………….

Court on ……….and otherwise completed the administration thereof.

AND WHEREAS the said A is fully satisfied with the correctness of the accounts and that he has not committed any act or mismanagement, waste, misfeasance or malfeasance in the course of the administration thereof.

NOW THIS DEED WITNESSETH THAT in the circumstances aforesaid, the said A does hereby release the said B from all claims, proceedings, costs and demands whatsover in relation to management or administration of the estate and affairs ancillary or incidental thereto and from all flabilities as to accounts, and dealing with the said estate of the testator or the income thereof
