Notice Under Section 106 of the Transfer of Property Act, 1882 for Ejectment

Dear Sir/Madam,
Under instructions from and on behalf of my client, Mr./Ms. _______ (Son/Daughter of ________, Resident of ________, hereinafter referred to as “my client”), I hereby serve you with the following notice:

That the property bearing No. _______ situated at _______ in the city of _______ (hereinafter referred to as the “said property”) is owned and possessed by my client.

That at your request, my client inducted you as a tenant in respect of the said property under a tenancy agreement for residential/commercial purposes. The agreed monthly rent for the said property was fixed at Rs. _______ (Rupees _______ Only) per month, payable in advance/by the ____ day of each calendar month.

That the tenancy of the said property was granted to you as a monthly tenancy, which is terminable by giving a notice under Section 106 of the Transfer of Property Act, 1882.

I hereby give you notice, requiring you to quit, vacate, and deliver vacant possession of the said property by the end of _______ (last day of the month/year as per the notice period) and to remove all your belongings and hand over the peaceful possession of the said premises to my client by the said date.

From the expiry of the notice period, i.e., from _______ (date following the last day of the month mentioned above), the tenancy hereto subsisting shall stand terminated, and the relationship of landlord and tenant between my client and you shall cease forthwith.

In case you fail to vacate the said premises as per this notice, you shall be considered a trespasser, and my client shall be entitled to initiate legal proceedings for your eviction under applicable laws, including the recovery of possession and damages. You will also be liable to pay damages/mesne profits at the rate of Rs. _______ per month/day for the unauthorized occupation of the premises until such time you vacate the said property or are lawfully evicted.
You are requested to treat this notice with utmost urgency and comply with its terms to avoid unnecessary legal complications and liabilities.
