PETITION FOR GRANT OF LETTERS OF ADMINISTRATION

The humble petition of ____________, son/daughter of the late __________, residing at ______________, most respectfully showeth as under:

  1. Details of the Deceased:
    That the late A.B., son/daughter of _________, residing at _____________, expired on _________ (date) at ________ (place). The deceased left behind certain movable and immovable properties located within the jurisdiction of this Hon’ble Court. A description of the said properties is provided in the affidavit annexed to this petition.

  2. Details of Legal Heirs and Relatives of the Deceased:
    A list of the relatives of the deceased, along with their respective residences, is as follows:

    • Petitioner: Son/Daughter of the deceased, residing at ______________.
    • Sri __________ (Brother): Residing at ______________.
    • Smt. __________ (Widow): Residing at ______________.
    • Smt. __________ (Mother): Residing at ______________.
    • Smt. __________ (Daughter): Residing at ______________.
  3. Right of the Petitioner to the Letters of Administration:
    That the petitioner, being the son/daughter of the deceased, is entitled to seek the grant of Letters of Administration to administer the estate of the deceased.

  4. Details of the Estate of the Deceased:
    That the deceased died leaving behind properties mentioned in the schedule annexed hereto, which form part of the estate requiring administration.

  5. Absence of Prior Applications:
    That, to the best of the petitioner’s knowledge and belief, no prior application has been made by any individual to any other court for the grant of Letters of Administration for the estate of the deceased.

  6. Jurisdiction:
    That this Hon’ble Court has the jurisdiction to entertain and adjudicate upon this petition, as the properties of the deceased are situated within its territorial limits.

PRAYER

In view of the above, the petitioner most humbly prays that this Hon’ble Court may graciously be pleased to:
a) Grant Letters of Administration to the petitioner for the estate of the late A.B., as described in the schedule annexed; and
b) Pass such further or other orders as this Hon’ble Court may deem fit and proper in the interest of justice.

And for this act of kindness, the petitioner shall, as in duty bound, ever pray.
