CONTEMPT PETITION UNDER SECTIONS 11 & 12 OF THE CONTEMPT OF COURTS ACT, 1971

MOST RESPECTFULLY SHOWETH:

  1. That the petitioners are filing this contempt petition to bring to the attention of this Hon’ble Court the wilful and deliberate non-compliance of its orders by the respondents, thereby constituting contempt under Sections 11 and 12 of the Contempt of Courts Act, 1971.

  2. That the President of the Residents Welfare Association, __________, New Delhi filed Civil Writ Petition No. ______ of ______ in this Hon’ble Court seeking reliefs related to the protection of the area in Khasra No. 78/21/2, including plots belonging to the petitioners.

    • That this Hon’ble Court was pleased to issue a status quo order dated 01.10.2003, restraining respondents, including the Delhi Development Authority (DDA), from demolishing constructions in the impugned area.
    • Copies of the said orders are annexed as Annexure A-1, A-2, and A-3.
  3. That despite being aware of the court’s orders, the respondent DDA and its officers failed to comply with the directions and, on 04.01.2003, willfully demolished the constructions raised on the plots belonging to the petitioners, namely Plot Nos. 1, 2, 3, 4, 21, 22, 35, and 36 in Khasra No. 78/21/2.

  4. That the petitioners, along with the Residents Welfare Association, had repeatedly apprised the respondents of the court’s orders through various written communications, including a representation dated 03.12.1998. A copy of the representation is annexed as Annexure A-5. However, these representations were blatantly ignored.

  5. That the demolition carried out by the respondents caused extensive damage to the properties of the petitioners. Photographic evidence of the demolished area is annexed as Annexure A-6.

  6. That it is pertinent to mention that the respondents, by their actions, have not only caused irreparable harm to the petitioners but have also undermined the authority of this Hon’ble Court by violating its orders. Such conduct constitutes contempt as defined under the Contempt of Courts Act, 1971.

  7. That the following officers of the DDA are directly responsible for the contemptuous actions and are, therefore, liable to face contempt proceedings:

  8. That the cause of action for the present petition arose on 04.01.2003, when the demolition was carried out despite the subsisting status quo orders, and continues to persist due to the respondents’ deliberate non-compliance.

PRAYER

In light of the aforementioned facts and circumstances, it is most respectfully prayed that this Hon’ble Court may be pleased to:

  1. Initiate contempt proceedings against the named respondents for willfully and deliberately violating the status quo orders passed by this Hon’ble Court in Civil Writ Petition No. ______ of ______.
  2. Direct the respondents to compensate the petitioners for the damages caused to their properties as a result of the unlawful demolition.
  3. Pass such other and further orders as this Hon’ble Court may deem fit and proper in the interest of justice.
