Special case on question of law arising during reference of differences under building contract

In the Matter of an Arbitration between [parties] and In the Matter of the Arbitration and Conciliation Act, 2015 Special Case THIS is a special case stated for the decision of the court [pursuant to an order of [the Honourable Mr. Justice ______________] dated ________ ] in accordance with section 8 of the Arbitration and Conciliation Act, 2015. By a contract in writing (annexed hereto and marked M. N. 1) dated the ______ day of _________, made between [claimant] (hereinafter called the claimant) and [respondent] (hereinafter called the respondent) the claimant agreed to build for the respondent and the respondent agreed to pay for a house to be built on certain land of the respondent at _________ [place] in accordance with a specification and plans in the said contract referred to at a price of Rs._______ or such other sum as should become payable in accordance with the conditions of the said contract. One of the conditions of the said contract was that any dispute that might arise between the parties should be referred to arbitration and a dispute did arise and was referred to me as sole arbitrator. At the hearing before me it was contended on behalf of the claimant that in calculating the amount due under the said contract I ought to have regard to certain correspondence between the parties relating to a contract dated the ________ day of ________ for another house being built by the respondent for the claimant on the adjoining site but having heard the objection of the respondent I declined to admit such correspondence as evidence. A bundle containing the said correspondence is annexed hereto and marked ______. SUPPLEMENTAL AGREEMENT FOR THE SUBSTITUTION OF TRADE

THIS SUPPLEMENTAL DEED made this _________ day of ____________, 20__, between __________, a company registered under the Companies Act, 2013 and having its registered office at ________________________ (hereinafter referred to as “the Company”) of the ONE PART AND Sh. ____________________________, s/o ____________________, r/o ________________________________ (hereinafter referred to as “the Apprentice”) of the OTHER PART; (The Company and the Apprentice are hereinafter collectively referred to as the “Parties; and the term “Party” refers to either one of them, as the context may require). WHEREAS On __/__/20__, the Parties entered into an apprenticeship agreement (hereinafter referred to as “the Principal Agreement”) for the training of the Apprentice in the trade of _____________ by the Company. In consideration of the mutual covenants and agreements set forth in this Supplemental Agreement, the Parties hereby agree to vary the terms and conditions of the Principal Agreement. NOW THIS DEED WITNESSESTH AS UNDER: INTERPRETATIONS 1.1   The Principal Agreement shall remain in full force and effect and this Supplemental Agreement is a supplemental to the Principal Agreement and except where the context otherwise requires, words and expressions defined in the Principal Agreement bear the same meaning when used herein, including recitals.  1.2   The Principal Agreement shall be varied in accordance with the terms herein contained with effect from the date hereof (“Effective Date”). VARIATION TO THE PRINCIPAL AGREEMENT In consideration of the proficiency of the Apprentice in the trade of _________________, the Parties agree to vary the Principal Agreement to the extent that the Company will forthwith train the Apprentice in the trade of _____________ instead of in the trade of _______________. The Parties hereby agree that the clause ___ of the Principal Agreement be altered to the following extent – “…………………………………………………………………………………………………………………………………………………………………………” APPLICABLE LAW The rights and liabilities of the Apprentice and the Company shall, so far as it relates to anything which is not expressly provided herein, be governed by the provisions of the Apprentice Act, 1961 and the rules and regulations framed there under. MISCELLANEOUS In the event of any inconsistency arising between this Supplemental Agreement and the Principal Agreement, this Supplemental Agreement shall prevail subject only to the variation herein contained.
