LEASE DEED
This Lease Deed is made and executed at New Delhi on this ___ day of ___ (Month, Year)
BETWEEN
Smt. Sudarshan Kaur, wife of Sh. Paramjit Singh, residing at House No. M-170, Greater Kailash-II, New Delhi, hereinafter referred to as the LESSOR (which expression shall, unless repugnant to the context or meaning thereof, include her legal heirs, successors, executors, administrators, representatives, and assigns) of the FIRST PART.
AND
M/s. Dave Thomson Associates (India) Pvt. Ltd., a company registered under the Companies Act, 2013, having its registered office at Satyug-Villa, 1st Floor, 5, Gurunanak Nagar, Off Shankarshet Road, Pune, acting through its authorized representative Mr. H. R. Srinivas, hereinafter referred to as the LESSEE (which expression shall, unless excluded by or repugnant to the context, mean and include its successors, successors-in-interest, and assigns) of the SECOND PART.
WHEREAS:
- The Lessor is the absolute owner of the basement portion of the property situated at M-170, Greater Kailash-II, New Delhi, admeasuring 760 square feet (approximate covered area) (hereinafter referred to as the “Demised Premises”).
- The Lessee has expressed its desire to take the Demised Premises on lease for lawful purposes, and the Lessor has agreed to lease the same to the Lessee on mutually agreed terms and conditions as detailed herein.
NOW THIS LEASE DEED WITNESSETH AS UNDER:
1. LEASE TERM AND RENT
1.1 The Lease is granted for an initial term of 24 months, commencing from ___ (Start Date) and ending on ___ (End Date). 1.2 The monthly rent shall be ₹4,000/- (Rupees Four Thousand Only), exclusive of electricity, water charges, and any other utilities or taxes. Rent shall be payable on or before the 7th day of each calendar month. 1.3 If the Lease is renewed after the initial period of 24 months, the monthly rent shall increase by 10% annually.
2. SECURITY DEPOSIT
2.1 The Lessee has paid a refundable, interest-free security deposit of ₹36,000/- (Rupees Thirty-Six Thousand Only) via Pay Order No. ____, dated ___, drawn on (Bank Name). 2.2 The security deposit shall be refunded to the Lessee upon the termination of the Lease, subject to any deductions for unpaid dues or damages caused by the Lessee beyond normal wear and tear.
3. TERMINATION
3.1 Either party may terminate the Lease by giving three (3) months’ prior written notice. 3.2 Upon termination, the Lessee shall hand over peaceful and vacant possession of the Demised Premises in the same condition as it was provided, except for normal wear and tear.
4. RESPONSIBILITIES OF THE LESSEE
4.1 The Lessee shall:
- Pay the agreed monthly rent and all applicable utility bills promptly.
- Use the Demised Premises solely for authorized purposes.
- Maintain the premises in a tenantable condition and carry out minor repairs as required.
- Permit the Lessor or their authorized representatives to inspect the premises during reasonable hours. 4.2 The Lessee shall not:
- Make any permanent alterations to the premises without prior written consent from the Lessor.
- Sublet or assign the premises without the Lessor’s consent.
5. RESPONSIBILITIES OF THE LESSOR
5.1 The Lessor shall:
- Ensure uninterrupted enjoyment of the property by the Lessee during the lease term.
- Be responsible for major structural repairs to the property.
- Pay property taxes and municipal charges related to ownership.
6. FORCE MAJEURE
6.1 In the event of damage or destruction to the Demised Premises due to fire, earthquake, flood, or any other force majeure event, the Lease shall be suspended until the premises are restored to their original condition.
7. ARBITRATION
7.1 Any dispute arising under this Lease Deed shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, as amended. The arbitration shall be conducted by a sole arbitrator appointed by mutual consent of both parties. The arbitration proceedings shall take place in New Delhi.
8. MISCELLANEOUS
8.1 The cost of stamp duty and registration for this Lease Deed shall be borne equally by the Lessor and the Lessee. 8.2 The original Lease Deed shall remain with the Lessor, and a duplicate copy shall be retained by the Lessee.
