Relinquishment Deed Format for Property Transfer in India

DEED OF RELINQUISHMENT

This Deed of Relinquishment is executed at [City, e.g., Delhi] on this [Date] day of [Month, Year].

BY

  1. [Name], wife of [Name], daughter of Late [Name], resident of [Address], hereinafter referred to as the First Releasor.
  2. [Name], wife of [Name], daughter of Late [Name], resident of [Address], hereinafter referred to as the Second Releasor.
  3. [Name], wife of [Name], daughter of Late [Name], resident of [Address], hereinafter referred to as the Third Releasor.

Collectively referred to as the Releasors, which term shall, unless repugnant to the context, include their legal heirs, successors, administrators, and assigns, of the First Part.

IN FAVOUR OF

[Name], wife of Late [Name], resident of [Address], hereinafter referred to as the Releasee, which term shall, unless repugnant to the context, include her legal heirs, successors, administrators, and assigns, of the Second Part.

WHEREAS

  1. The late [Name] was the sole and absolute owner of the property situated at [Address, Property No.], measuring [Area, e.g., 200 square yards], comprising a [Structure Description, e.g., Double Storey House].
  2. The said [Name] passed away on [Date of Demise], leaving behind the Releasors and the Releasee as his only legal heirs under [Applicable Law, e.g., the Hindu Succession Act, 1956], each entitled to an equal [Proportion, e.g., 1/5th share] in the property.
  3. Besides the Releasors and the Releasee, there are no other legal heirs or individuals entitled to or claiming any right, title, or interest in the aforementioned property.
  4. The Releasors, out of natural love and affection, and without any monetary consideration, are desirous of relinquishing their respective shares in the aforementioned property in favor of the Releasee.

NOW THIS DEED WITNESSES AS FOLLOWS:

  1. The Releasors hereby voluntarily and without coercion or undue influence, relinquish and release all their rights, titles, and interests in the property situated at [Property Address], measuring [Area], in favor of the Releasee. By virtue of this deed, the Releasee becomes the sole and absolute owner of the entire property, holding a total [Fraction, e.g., 5/5ths] share.
  2. The Releasors, their legal heirs, successors, and assigns shall have no claim, right, or title in the said property.
  3. The possession of the said property is already with the Releasee, who shall continue to enjoy uninterrupted possession and ownership.
  4. The Releasee is fully entitled to mutate the property in her name and have all relevant records updated with the appropriate authorities based on this deed.
  5. The original title deeds and other relevant documents pertaining to the property are in the possession of the Releasee.
